EPA and Corps of Engineers Announce Intent to Review, Rescind or Revise “Navigable Waters of the United States” Under CWA

In accordance with President Trump’s Executive order dated February 28, 2017, the EPA and Corps of Engineers announced on March 6, 2017, their intent to review, rescind or revise the term “navigable waters of the United States” as defined in the Clean Water Act. The agencies will consider interpreting the term consistent with Justice Scalia’s opinion in Rapanos v. United States, 547 U.S. 715 (2006) The change will be to 2015 Rule, 31.
