BP Oil Spill Case Update - Phase One Ruling

Today, Judge Carl Barbier of the Eastern District of Louisiana issued his ruling for Phase One of the BP oil spill trial.

Percentage of fault for the spill:

BP 67%
Transocean 30%
Halliburton 3%
In addition, BP was found to be grossly negligent and subject to enhanced penalties.  Although BP's conduct warranted punitive damages under maritime law, Judge Barbier held that BP cannot be held liable for punitive damages under current Fifth Circuit Precedent.  Also, Transocean is not entitled to limitation.
