Coast Guard Adjusts Limits of Liability under OPA 90

The U.S. Coast Guardon Aug. 13, 2019 published a final rule for increasing the limits of liabilityfor Vessels, Deepwater Ports and Onshore Facilities. The Act requiresconsumer price index adjustments in the limitation of liability. The CoastGuard is responsible for adjusting the limits of liability for vessels,deepwater ports, and onshore facilities. 

As the Department ofthe Interior’s Bureau of Ocean Energy Management (BOEM) is responsible foradjusting the limits of liability for offshore facilities, these increases donot apply to offshore facilities.

The adjusted limits ofliability will go into effect on November 12, 2019.
