Amendment to Death on the High Seas Act Proposed

A bill was introduced in the U.S. Senate by Senator McSally (R-AZ)  to amend title 46, United States Code, (Death on the High Seas Act)  to provide for a cause of action by the family of a military service member who dies from a collision on the high seas and other purposes.

The amendment would allow the service member's  spouse, parent, child, dependent relative, or estate to recover pecuniary and non-pecuniary damages and have a jury trial.The proposed amendment is limited to members of the service killed in collisions and while serving on the vessel beyond 12 nautical miles from the shore of the U.S. The U.S. government's sovereign immunity is not waived.
