New Rules of Practice and Procedure for Administrative Hearings of the OALJ

The U.S. Department of Labor has published the final new Rules of Practice and Procedure for Administrative Hearings Before the Office of Administrative Law Judges. These go into effect on June 18, 2015. The new rules relate to commencement of discovery (which cannot begin until after an ALJ issues a notice or order, places a limit on interrogatories and depositions (25 interrogatories and 10 depositions), physical and mental examinations, expert reports, time computation and time limits (weekends and holidays are included), motion practice including summary decisions, the pre-hearing statement, and analogous sanctions to Rule 11 of the FRCP.
