Pruitt Announces Next Step to Redefine Waters of the U.S. under Clean Water Act

The EPA along with the U.S. Corps of Engineers announced on June 15, 2018 that the next step will be taken to redefine “waters of the United States” (WOTUS) under the Clean Water Act.The EPA and Corps finalized a rule on January 31, 2018 (https://www.epa.gov/newsreleases/epa-and-army-finalize-waters-united-states-applicability-date) The former 2015 Rule was enjoined by a ruling of the U.S. Court of Appeals for the Sixth Circuit; but that was reversed by the U.S. Supreme Court on the basis that the appeals court lacked jurisdiction.Both agencies are working on a new definition of WOTUS.
